El objetivo de este trabajo es formular un análisis de la incorporación de los métodos alternativos de resolución de conflictos (conciliación, mediación y arbitraje) para el mejoramiento del acceso a la justicia en la legislación ecuatoriana. Por lo tanto, la investigación tiene un enfoque descriptivo, a partir de la revisión de documentos suscritos por la Organización de los Estados Americanos (OEA), análisis de literatura especializada, normativa legal vigente, datos estadísticos provenientes del Consejo de la Judicatura y entrevistas. Finalmente, se concluye que el Estado ecuatoriano hace 20 años, inicio un proceso de incorporación de los métodos alternativos al sistema de justicia y debe continuar con la actualización de la normativa y desarrollo de lineamientos y políticas públicas acordes con las tendencias actuales y estándares internacionales para el acceso a la justicia a través de los métodos alternativos.
The objective of this work is to formulate an analysis of the incorporation of alternative methods of conflict resolution (conciliation, mediation and arbitration) for the improvement of access to justice in Ecuadorian legislation. Therefore, the research has a descriptive approach, based on the review of documents signed by the Organization of American States (OAS), analysis of specialized literature, current legal regulations, statistical data from the Judiciary Council and interviews. Finally, it is concluded that the Ecuadorian State 20 years ago began a process of incorporating alternative methods into the justice system and should continue with the updating of regulations and development of guidelines and public policies in line with current trends and international standards for access to justice through alternative methods.
