EL PRINCIPIO DE INMEDIACIÓN EN SEGUNDA INSTANCIA SEGÚN EL CÓDIGO ORGÁNICO GENERAL DE PROCESOS

Description

La Constitución del 2008 establece que el sistema procesal ecuatoriano debe ser oral en todas las materias e instancias, y que el mismo se regirá en virtud de los principios de inmediación, concentración y contradicción, en este contexto en el año 2015 se expidió el Código Orgánico General de Procesos COGP, que pretendió generar el marco normativo necesario para la aplicación de los mismos. Si bien se reconoce que los procesos establecidos en esta norma, sobre todo en primera instancia efectivamente promueven la aplicación de los principios enunciados, en especial el de inmediación, en segunda instancia se vulnera la aplicación del mismo, en virtud de la inexistencia de presentación de prueba salvo el caso de tratarse de prueba nueva, razón por la cual el tribunal deberá juzgar a partir de los expedientes de juicio.
The Constitution of 2008 establishes that the Ecuadorian procedural system must be oral in all matters and instances, and that it will be governed by the principles of immediacy, concentration and contradiction, in this context in 2015 was issued the Organic Code General de Procesos COGP, which sought to generate the necessary regulatory framework for their application. While it is recognized that the processes established in this rule, especially in the first instance, effectively promote the application of the above principles, especially that of immediacy, in the second instance, the application of the same is violated, due to the lack of presentation of proof except in the case of new evidence, which is why the court must judge from the trial files.
