THE PRESIDENTIAL REGIME IN A POST-CONSULTATION CONTEXT A DECADE LATER TO THE CONSTITUTION OF 2008

On the occasion of the ten years of the Constitution and the recent Referendum, held few months ago, I will focus my attention on the Executive Power and analyse which has been the impact of the questions on indefinite re-election and on the reform of the Council for Public Participation and Social Control. Regarding the first one, it is not possible to deny its positive character, but to what extent can we say the same of the immediate re-election that is contained on the Montecristi Constitution? Regarding the second question, the Transitory Council has awakened expectations and controversies; In any case, the country wants to see an institutional restructuring. In my opinion, the hyper-presidential design created by the Constitution constitutes a difficult challenge to reach an institutional democracy.
Con motivo de los diez años de la Constitución y de la Consulta Popular realizada hace unos meses se centrará la atención en el Poder Ejecutivo y se analizará la incidencia que han tenido las preguntas sobre la reelección indefinida y la reforma del CPCCS. Respecto de la primera, no se ha podido objetar su carácter positivo pero ¿se podrá decir lo mismo de la reelección inmediata que es parte de la Constitución de Montecristi? En cuanto a la segunda, el Consejo Transitorio ha despertado esperanzas y controversias; en todo caso, el país quiere ver una reestructuración institucional. En mi criterio, el diseño hiper-presidencial que trae la Constitución es un difícil reto para alcanzar una institucionalidad democrática.
