THE CONSTITUTION OF 2008 AND THE CONSTITUTIONAL PRECEDENT

Description: The present paper accomplishes a documentary and critical analysis of the constitutional precedent in Ecuador and its configuration in the new Constitution of 2008; Evidencing certain inconveniences of interpretation and highlighting importance and degree of importance of the present as the amendment to the articles of incorporation’s motor and the dialectic construction of history, without brushing aside the judge like subject of her same, for which will be able to come across constant arguments that the authors in this theme, without stopping to criticize the status sell off quo in use.
El presente artículo analiza documental y críticamente el precedente constitucional en el Ecuador y su configuración en la nueva Constitución de 2008, evidenciando ciertos inconvenientes de interpretación y resaltando la importancia y relevancia de la jurisprudencia como motor del cambio social y la construcción dialéctica de la historia. Sin dejar de lado al juez como sujeto del cambio, para lo cual los autores del trabajo se proponen discusiones constantes en este tema, sin dejar de criticar el status quo de la doctrina vigente.
