Since the Ecuadorian Constitution of Montecristi came into force in 2008, it has created many expectations regarding the development of its content, since the realization of the rights and the structure generated with it, reflected the essence of social needs in Ecuador. One of its main objectives was to achieve material justice, and above all to create access by those who historically have not had a voice, and one of the main mechanisms for this was to establish jurisdictional guarantees close to Ecuadorian society, easy access; However, this purpose seems to have gone through a series of obstacles that have been fading away. This article pretends to observe briefly the development that these guarantees have had.
Desde que la Constitución ecuatoriana de Montecristi entró en vigencia en 2008, ha creado muchas expectativas en cuanto al desarrollo de su contenido, ya que la efectivización de los derechos y la estructura generada con ella, reflejaba la esencia de las necesidades sociales en el Ecuador. Uno de sus principales objetivos era lograr una justicia material, y sobre todo crear su acceso por parte de los que históricamente no han tenido voz, y uno de los principales mecanismos para ello, fue el establecer unas garantías jurisdiccionales cercanas a la sociedad ecuatoriana, de acceso fácil; sin embargo, esa finalidad parecería haber atravesado una serie de obstáculos, que la han ido desvaneciendo. Este artículo pretende observar críticamente a breves rasgos el desarrollo que estas garantías han tenido.
