La vida digna es un Derecho reconocido en la Constitución de la República del Ecuador, mediante el cual la Carta Magna garantiza a todas las personas sin excepción alguna el adecuado acceso a una alimentación de calidad, salud, vivienda, nutrición, educación, vestuario, hecho que en algunas ocasiones es transgredido por la falta de seguridad jurídica en ciertas normas que integran el ordenamiento jurídico nacional, como por ejemplo en el caso de las normas que regulan el derecho de alimentos congruos en beneficio del cónyuge, puesto que este tema carece de preceptos normativos específicos que coadyuven a la resolución de la causa, en relación al monto económico por concepto de alimentos congruos, mediante la aplicación del método cualitativo, con alcance descriptivo y exploratorio se evidencio la vulneración del derecho a la vida digna del cónyuge beneficiario del derecho de alimentos.
Ecuadorian legislation is quite clear regarding the protection of the rights of minors, despite this, it does not enshrine within the legal system an express procedure for the issue of the recovery of minors and less when they are in custody. abroad, as a result of this, the Judicial authorities in family matters are obliged to interpret the norm in making their decisions, thus violating the best interests of the minor. It should be noted that in the absence of an express procedure, the actions to recover the minor are not always the most effective, which is why in the development of this investigative work it is intended to carry out an analysis of the damages caused to the parents but especially to the minor, as well as the current and current legislation that governs our country will be analyzed to propose alternatives and solutions that in practice are efficient to recover the minor without affecting him and above all guaranteeing the full development of his rights
