La fundamentación teórica del presente proyecto se realizará mediante métodos analíticos- sintéticos a través de una revisión bibliográfica en el ámbito jurídico tanto nacional como internacional, respecto al tema tratado y datos de cifras de mortalidad de féminas. Se realizará la recolección de información sobre si existe vulneración ya sea formal o material al momento que se tipifica en el Ecuador dicho tipo penal, así como una propuesta analítica sintética que partió de un análisis de los elementos de dicha conducta típica -femicidio- frente a los delitos de asesinato, de éstos se observó que la única diferencia que existe es: su autonomía en la muerte de una mujer, dando así pautas a una discriminación hacia el resto de la sociedad. Por ello la propuesta que se hace es que el femicidio se suprima o se lo incluya en el tipo penal asesinato
The theoretical foundation of the present project will be carried out by means of analytical-synthetic methods across a bibliographic review in the legal field both national and international, with respect to the treated subject and data on mortality figures of females. The compilation of information will be done on whether there is a formal or material violation at the time that this type of crime is typified in Ecuador that mentioned penal type, as well as a synthetic analytical proposal that started with an analysis of the elements of such typical behavior -femicide- opposite to the crimes of murder, of these it was observed that the only difference that exists is: its autonomy in the death of a woman, thus giving guidelines to a discrimination towards the rest of society. Therefore, the proposal is that femicide is deleted or included in the criminal type of murder.
