La presente investigación analiza los delitos sexuales infantiles en la parroquia Molleturo de la ciudad de Cuenca y la eficacia de las normas penales respecto a la protección de la indemnidad sexual en niños menores a 12 años, comprobando la eficacia de la función retributiva de la norma penal respecto al incremento de la carga punitiva que se ha establecido con la vigencia del Código Orgánico Integral Penal, en comparación con el Código Penal derogado. Para esta investigación se utilizó el método histórico-lógico e inductivo-deductivo; demostrando que la mayor carga punitiva en los delitos de abuso sexual y violación a menores de 12 años, establecida con la vigencia del Código Orgánico Integral Penal, no tiene los resultados disuasivos a fin de disminuir este tipo de delitos, más por el contrario, se advierte un incremento estadístico en la vulneración de este tipo de bienes jurídicos.
The present investigation analyzes the sexual crimes for children in the Molleturo parish of the city of Cuenca and the effectiveness of the penal norms regarding the protection of sexual indemnity in children under 12 years, verifying the effectiveness of the retributive function of the criminal norm regarding the increase of the punitive load that has been established with the validity of the Comprehensive Organic Penal Code, in comparison with the repealed Penal Code. For this investigation the historical-logical and inductive-deductive method was used; demonstrating that the highest punitive burden in the crimes of sexual abuse and rape of children under 12 years of age, established with the validity of the Comprehensive Criminal Organic Code, does not have dissuasive results in order to diminish this type of crime, on the contrary, it warns a statistical increase in the violation of this type of legal assets.
