El matrimonio ha sido considerado desde el inicio de los tiempos como un contrato que produce efectos jurídicos para quienes participan en él, el presente trabajo tiene como finalidad realizar un análisis jurídico mediante la revisión bibliográfica y el método analítico critico de la evolución histórica del matrimonio haciendo una comparación jurídica con la Unión de Hecho, figura legal que toma importancia a partir de la Constitución del 2008, comprobando que la sentencia N.º 11-18CN/19, emitida por la Corte Constitucional, es un instrumento legal que puso en evidencia que el Art. 67 de Constitución vulnera Derechos Humanos y es contrario al principio de igualdad y no discriminación entorno al matrimonio y a quienes pueden acceder a él.
From the beginning of time, marriage has been considered as a contract that has a legal effect on those who take part in it. This study aims to conduct a legal analysis through the bibliographical revision and the critical-analytical method of the historical evolution of marriage legally comparing it with the Common-law Union, a legal status that look importance since the 2008 Constitution, corroborating that the sentence No. 11-18CN/19 issued by the Constitutional Courthouse, is a legal instrument that proved the Article 67of the Ecuadorian Constitution infringes Human Rights and is detrimental to the Principle of Equality as well as no discrimination over marriage, and those who have access to it.
