Las actuaciones lascivas contra cadáveres son más habituales de lo que podríamos llegar a imaginar, sin embargo, la falta de visibilidad sobre estas nos ha hecho minimizar la importancia del tema, pues, a pesar del repudio que estos actos nos puedan significar, más allá del rechazo moral, no hay otra forma de reprender a quien los ejecuta. El daño causado sobre la memoria del difunto, aunque es latente, no es susceptible de reproche ni reparación alguna, pues, no se considera que se haya vulnerado ningún derecho, por lo tanto, no existe ningún tipo de protección a esta extensión de la dignidad. Este trabajo de investigación tiene como objetivo determinar la necesidad y posibilidad del reconocimiento del derecho a la dignidad póstuma, a través de métodos cualitativos, explorativos y descriptivos, tomando en consideración, además, la aplicación de teorías direccionadas al reconocimiento de derechos, doctrina y derecho comparado.
Lascivious actions against corpses are more common than people might imagine; however, the lack of visibility on these has made us minimize the importance of the subject because, despite the repudiation that these acts can mean to us beyond moral rejection, there is no other way to punish the person who executes them. The damage caused on the memory of the deceased, although latent, is not susceptible to reparation, since it is not considered that any right has been violated, therefore, there is no protection of postum dignity. This research has the objective to determine the need and possibility of recognition of the right to posthumous dignity through qualitative, exploratory and descriptive methods, taking into account the application of theories about the recognition of rights, doctrine and compared law.
