La violencia de género y hacia miembros de la familia, es una especialidad que no solo debe ser entendida en un plano penal, sino también dentro del Derecho de Familia y el Derecho Civil de las personas. Debe ser entendido para un mejor amparo de los derechos, particularmente de la mujer que, históricamente ha sido la mayor víctima de violencia dentro del matrimonio y también los miembros del núcleo familiar, en especial los hijos pueden ser víctimas de violencia, pero sin duda alguna, la mujer es comúnmente la víctima de violencia dentro de la familia. El divorcio no solo debe ser comprendido como la mera disolución del matrimonio, sino que, el divorcio causal por violencia de cualquier tipo contra la mujer y los demás miembros del núcleo familiar, es la protección integral de uno de los cónyuges o cualquiera de los miembros del núcleo familiar, de los diferentes tipos de violencia previstos en el COIP. Finalmente, la crítica a nuestra sociedad conservadora, a nuestra ley y como último punto la conclusión a la que se llegó y las recomendaciones que son necesarias para una mayor protección de los derechos, sobre todo a la mujer como principal víctima de violencia.
Domestic violence and violence against family members is a specialty that not only should be understood on a criminal level, but also within the Family Law and Civil Law of individuals. It must be understood for better protection of the rights, particularly of the woman who, historically, has been the greatest victim of violence within marriage and also the members of the family nucleus, especially the children can be victims of violence, but without a doubt, the woman is commonly the victim of violence within the family. Not only should divorce be understood as the mere dissolution of the marriage, but the causal divorce for the violence of any kind against the woman and the other members of the family nucleus, is the integral protection of one of the spouses or any of the members of the family nucleus, from the different types of violence foreseen in the INTEGRAL ORGANIC CRIMINAL CODE. Lastly, the criticism to our conservative society, to our law, and as the last point the conclusion reached and the recommendations that are necessary for greater protection of the rights, especially to the woman as the main victim of violence.
