El tema investigado hace relación al análisis jurídico de la mediación penal en las salidas alternativas en la justicia especializada de adolescentes infractores. Este tema fue escogido, debido a la problemática de la sociedad ecuatoriana en el cometimiento de estas acciones antijurídicas de parte de adolescentes infractores y transgreden sus derechos al momento de ser juzgados, que es en donde se sitúa el objeto de estudio, siendo el campo de acción todo el contexto de la mediación penal como una alternativa de salida en los conflictos en donde estén inmersos adolescentes o menores. Con este argumento se ha propuesto como objetivo principal el de analizar jurídicamente de la mediación sus ventajas y desventajas, vislumbrándolo como un método alterno a la solución de conflictos en adolescentes infractores. Para ello se debe identificar los argumentos legales, que sustentan la mediación penal como argumento para la solución de conflictos en donde se hallasen involucrados menores
The subject investigated is related to the legal analysis of criminal mediation in alternative outings in specialized justice for juvenile offenders. This issue was chosen, due to the problem of Ecuadorian society in the commitment of these unlawful actions by offending adolescents and transgress their rights at the time of being judged, which is where the object of study is located, being the field of action throughout the context of criminal mediation as an alternative to exit in conflicts where adolescents or minors are immersed. With this argument, it has been proposed as a main objective to legally analyze the advantages and disadvantages of mediation, as an alternative method to the resolution of conflicts in offender adolescents. For this, the legal arguments must be identified, which support the criminal mediation as an argument for the resolution of conflicts where minors were involved
