El nuevo Código Orgánico Integral Penal, tiene una elaboración técnico-sistemática acorde con la actual dogmática penal, que fue elaborada a lo largo del siglo XX; pues, el vigente Código Penal de nuestro país del año 1938, está plagado de incongruencias y contradicciones al punto de ni siquiera definir con exactitud que es delito; ni tampoco elementos básico de antijuridicidad y culpabilidad. Grandes tratadistas de talla internacional como Raúl Eugenio Zaffaroni criticaron la falta de sistematización coherente del Código Penal ecuatoriano; y en el ámbito interno, fue cuestionado por autores siendo Ernesto Albán Gómez y Rodrigo Bucheli Mera. Por ello, el aspecto de profundo contenido que se aprecia en el Código Orgánico Integral Penal.es “la renovación teórico-conceptual del delito incluyéndose la estratificación del mismo en los elementos de tipicidad, antijuridicidad y culpabilidad, aspecto que será tratado en la presente investigación jurídica.
The new Penal integral Organic Code has a technical-systernatic design in accordance to the current penal doctrine, prepared along XX Century. The current Penal Code passed in year 1938 is full of inconsistencies and contradictions; hence, not even offense has not been accurately, or basic elements of anti-legality and culpability. Great international writers, such as Raul Eugenio Zaffaroni critizizized the lack of consistent systematization of the Ecuadorian Penal Code, and in the internal field, it wasc questioned by its authors Ernesto Alban Gomez and Rodrigo Bucheli Mera; hence, the deep content sees in the Penal Integral organic Code is “the theoretical-conceptual renewal of offense, including stratification of the same in typicality elements, anti-legality and culpability, aspects that have been addressed in the current legal investigation.
