La fe pública del notario en la legislación ecuatoriana

Resumiendo este punto se puede manifestar que el Notario realiza de manera autónoma una función pública que corresponde al Estado y que se trata fundamentalmente en autentificar hechos o contratos jurídicos en fuerza de fe pública. En consecuencia se dice que el Notario, si bien administrativamente no es un órgano del Estado, si es una persona física a la que se le delega la facultad de dar fe, la cual ejerce con apogeo a normas jurídicas con autonomía. El Notario no es un funcionario público, no están sujetos al régimen jerárquico de la administración pública, no son parte de los poderes del Estado ni dependen de ellos, tampoco perciben sueldo del mismo, no tienen contrato con relación jurídica de dirección ni dependencia, no están sujetos a los derechos y deberes de los funcionarios oficiales, ni el Estado responde por sus actos jurídicos con fuerza de fe pública frente a todos incluyendo al Estado. Por lo tanto el Notario es la única persona investido de dar fe pública de todo acto y contrato que llega a su conocimiento
In short, a Notary autonomously undertakes a public function that is the Government’s obligation, legalizing and certifying public legal facts and agreements. Consequently, it is said that a Notary, though in the administrative aspect is not a part of the Government, he/she is a natural person that is invested of the power to certify, which is exercised in an autonomous fashion. A Notary is not a public official, and is not subject to the hierarchic regime of the public administration, and does not share Government powers, or depend from it, his/her wage is not paid by it, there is no agreement that provides his/her a dependency labor relation, he/she is not subject to Government officials’ rights and duties, the Government is not responsible for his/her legal public actions before all parties, including the Government. The Notary is the only person empowered to provide public faith of all acts and agreements brought to him/her.
