La presente es una tesis inmersa en el área Internacional ya que desde tiempos muy remotos los Estados se han preocupado por los derechos del niño ya que ellos son el presente y el futuro de los Estados, todos los países desean el bienestar y una patria donde no exista niños abandonados, niños en las calles, niños explotados. La adopción internacional toma un rol importante en el cual varios Estados han suscrito convenios para garantizar una familia idónea, permanente y definitiva a los niños, niñas y adolescentes que lo necesitan y se encuentren en aptitud social y legal para ser adoptados. Estos convenios entre Estados por medio del Derecho Internacional Privado regulan las relaciones entre las sociedades facilitando el movimiento de personas, por lo que se pretende difundir a la comunidad internacional la existencia de los diferentes tratados internacionales aplicados a la adopción nacional e internacional. Se ha detectado que dentro del ordenamiento jurídico la adopción internacional tiene varias falencias ya que no existe un procedimiento claro de adopción internacional. La metodología del trabajo investigativo incluye el análisis de doctrina, legislación, jurisprudencia, que tata de contextualizar a nivel conceptual metodológico y empírico lo cual dio como resultado una propuesta de reforma legal que sirva para garantizar los derechos de los niños y adolescentes básicamente.
This thesis is immersed in the international sphere, given that from early times the States have concerned themselves with the rights of children, as they represent the present and future of the States. All countries desire the wellbeing of their residents and a country in which there are no abandoned or exploited children, nor children in the street. International adoption has played an important role, in which various States have signed agreements in order to guarantee an ideal, permanent, and definitive family for the boys, girls, and teenagers that need them and who are socially and legally suitable for adoption. These agreements between States through the Private International Law regulate the relationships between the societies facilitating the movement of people. This serves to disseminate the existence of different international treaties related to national and international adoption throughout the international community. Within the legal system it has been detected that international adoption has various flaws, which are due to the lack of a clear procedure for international adoption. The methodology of this research includes an analysis of doctrine, legislation, and jurisprudence, which attempts to contextualize the situation at the methodological and empirical level, producing as a result a proposal for legal reform, which serves to guarantee the basic rights of children and teenagers.
