En el presente trabajo se demostrará que la excesiva aplicación de la prisión preventiva mantiene principal incidencia con el hacinamiento en los sistemas penitenciarios del país, esta situación caótica que se incrementó con la pandemia covid19. Siendo la medida cautelar de prisión preventiva en su aplicación de ultimo ratio, debiendo reunir requisitos establecidos en el COIP. Nuestro sistema judicial no cumple, sino que recurre a su aplicación sin establecer mejor criterio y con apego a lo establecido en la norma constitucional. El presente trabajo analiza la normativa establecida en el ámbito nacional e internacionales que le dan relevancia jurídica a la emergencia sanitaria, se analizael sistema carcelario y las políticas adoptadas por el estado ecuatoriano. También analizamos si se toma en cuenta el riesgo de contagio que se corre al aplicar prisión preventiva a una persona contagiada, ya que pone en peligro la viday la salud de las personas que se encuentran dentro de los centros carcelarios especialmente para las personas más vulnerables al covid-19.
In this work it will be shown that the excessive application of pretrial detention maintains the main incidence with overcrowding in the country's prison systems, this chaotic situation that increased with the covid19 pandemic. Being the precautionary measure of preventive detention in its application of last ratio, it must meet the requirements established in the COIP. Our judicial system does not comply, but resorts to its application without establishing better criteria and in accordance with what is established in the constitutional norm. This paper analyzes the regulations established at the national and international level that give legal relevance to the health emergency, the prison system and the policies adopted by the Ecuadorian state are analyzed. We also analyze whether the risk of contagion that is run when applying preventive detention to an infected person is taken into account, since it endangers the life and health of the people who are inside the prisons, especially for the most vulnerable people to covid-19.
