El conocimiento de embarque es un documento básico que promueve el comercio internacional porque contiene información comercial y legal, incluidos los contratos de transporte y descripciones de las mercancías. En el primer capítulo entraremos con los antecedentes, naturaleza jurídica y definiciones del conocimiento del embarque, así mismo su enfoque a la modalidad electrónica. A parte de ese tema, hablaremos sobre el sistema Ecuapass que rige Ecuador; el sistema Bolero que rige en ciertos países, que para mí opinión, son sistemas obsoletos; y el sistema Blockchain, un sistema moderno, del cual analizaremos por qué Ecuador no lo puede aplicar. En el segundo capítulo, nos concentraremos en estudiar tres normas internacionales cómo son las Reglas de Hamburgo, Haya-Visby, y especialmente las Reglas de Rotterdam ya que analizaremos los problemas que podría tener Ecuador frente a una ratificación, ya que evidentemente sería un gran avance hacia la tecnología porque existe una gran necesidad en el mercado de migrar hacia el uso de los conocimientos de embarque electrónico para que se puede transmitir de forma segura, integridad, fiabilidad y eficacia. Finalizando con su debida conclusión y recomendación.
The bill of lading is a basic document that promotes international trade because it contains commercial and legal information, including contracts of carriage and descriptions of goods. In the first chapter, we will enter with the background, legal nature and definitions of the bill of lading, as well as its approach to the electronic mode. Apart from that, we will talk about the Ecuapass system that governs Ecuador; the Bolero system that governs certain countries, which in my opinion, are obsolete systems; and the Blockchain system, a modern system, from which we will analyze why Ecuador cannot apply it. In the second chapter, we will concentrate on studying three international standards such as the Hamburg, Hague-Visby, and especially the Rotterdam rules, since we will analyze the problems Ecuador could have in the face of a ratification, since it would obviously be a great advance towards technology because there is a great need in the market to migrate towards the use of electronic bills of lading so that they can be transmitted in a safe, integral, reliable, and efficient manner. Concluding with its due conclusion and recommendation.
