El derecho a la verdad, ha surgido como concepto jurídico a través del contexto internacional, debido al desarrollo jurisprudencial que este comenzó a tener, y se refiere al derecho de las familias o de las víctimas de saber cuáles fueron los hechos o sucesos en un acontecimiento en el que se violaron derechos humanos. En este sentido, Vivian Newman (2009) lo define como: “El derecho individual y colectivo a saber los hechos, las circunstancias, las causas, las consecuencias, los responsables y las víctimas de las violaciones de los derechos humanos y el derecho internacional humanitario”. El objeto del presente trabajo consiste en un análisis investigativo, sobre como el derecho a la verdad ha pasado a ser en el contexto del Derecho Internacional, un derecho consuetudinario protegido y reconocido, y como en el Derecho interno (Ecuador) ha sido reconocido como uno de los mecanismos para una reparación integral, catalogándose de esta manera, como un derecho fundamental consagrado en la constitución de nuestro país.
The right to truth has emerged as a legal concept through the international context, this because of the jurisprudence development that acquired. This right concerns about the right that all victims and theirfamilies have to know what and how the events that violated their constitutional human rights where done. In this sense, Vivian Newman (2009) defines it as “The individual and collective right to have knowledge about the events, circumstances, causes, consequences, responsible people and the victims of human and international rights violations”. The object of the present work consists, in an investigative analysis about how the right to truth has become, in the International Rights concept, as a consuetudinary, protected, and acknowledged right, and in the internal right (Ecuador), recognized as one of the mechanisms to an integral repair, being cataloged in this manner, as a fundamental right consecrated in our country’s Constitution.
