El presente trabajo de investigación tiene como objetivo comprender la figura de Asilo Diplomático como una forma de protección a aquellas personas que son consideradas perseguidas políticas. A su vez, se encuentra fundamentado en la problemática jurídica y diplomática que adquirió el Gobierno ecuatoriano como consecuencia del otorgamiento de Asilo a Julian Assange. Para desarrollar esta investigación se analizó la situación jurídica del fundador de Wikileaks y su accionar durante su estancia en la Embajada del Ecuador en Londres. Asimismo, se analizaron los Tratados y Convenciones que el Ecuador ha suscrito y ratificado para así poder llegar a la conclusión de que es necesaria la creación de nuevas normas internas y la suscripción de nuevos Tratados Internacionales que regulen y fortalezcan correctamente la institución del Asilo en nuestro país, pues la problemática que se ha generado ha sido precisamente por la falta de aplicación e interpretación por parte de nuestras autoridades diplomáticas.
The purpose of this research work is to understand the concept of Diplomatic Asylum as a form of protection for those who are considered persecuted politically. In turn, it is based on the legal and diplomatic issues that the Ecuadorian Government acquired as a result of the granting of Asylum to Julian Assange. To develop this research, the legal status of the founder of Wikileaks and its actions during his stay at the Embassy of Ecuador in London was analyzed. Likewise, the Treaties and Conventions that Ecuador has signed and ratified were analyzed in order to reach the conclusion that it is necessary to create new internal regulations and to sign new International Treaties that regulate and strengthen the institution of Asylum in our country. The problem that has been generated has been precisely because of the lack of application and interpretation on the part of our diplomatic authorities.
