Se estudia la situación del consumo de cannabis para fines medicinales y terapéuticos enfocados en la actividad del autocultivo como parte del derecho a la salud y la autodeterminación dentro del Ecuador. Debido a que el cannabis se encuentra regulado junto con otras sustancias sujetas a fiscalización, es pertinente analizar también su tratamiento a nivel internacional y derecho comparado. Para el efecto realizamos un examen de viabilidad que nos permitirá determinar si es viable regular el autocultivo de cannabis en el Ecuador como parte del derecho esencial a la salud y capacidad de agencia de las personas. Concluimos el trabajo con lo que nos parece los cambios ajustados al deber ser y derechos humanos que se requieren aplicar en las leyes de nuestro país para regular el cannabis con fines medicinales y terapéuticos y más precisamente, el autocultivo. Incluyendo, además, como recomendación, que el lector interesado revise a profundidad la bibliografía analizada.
The situation of cannabis uses for medicinal and therapeutic purposes focused on the activity of self-cultivation as part of the right to health and self-determination within Ecuador is studied. Because cannabis is regulated along with other substances subject to control, it is also pertinent to analyze its treatment at the international level and comparative law. For this purpose, we conduct a feasibility test that will allow us to decide if it is feasible to regulate the self-cultivation of cannabis in Ecuador as part of the essential right to health and people's capacity for agency. We conclude the work with what we think are the changes adjusted to what should be and human rights that must be applied in the laws of our country to regulate cannabis for medicinal and therapeutic purposes and more precisely, self-cultivation. Also including, as a recommendation, that the interested reader review in depth the analyzed bibliography.
