El presente trabajo de investigación de tesis versa sobre un estudio al derecho que tienen el Ecuador a ejercer soberanía sobre la órbita sincrónica geoestacionaria del planeta, la incidencia de ejercer soberanía sobre este espacio que es considerado como ultraterrestre y un patrimonio de la humanidad, además de la necesidad de una delimitación del mismo basado en conceptos relacionados a la costumbre en el derecho internacional, a su vez mediante un análisis sobre las beneficios y aplicaciones que tiene la órbita sincrónica geoestacionaria de los satélites en el diario vivir de la raza humana narrando la incidencia del proyecto GEDI en situaciones actuales, a su vez analizamos la historia e incidencia de pasadas posturas en el ámbito diplomático por parte de los países ecuatoriales relacionadas a la órbita sincrónica geoestacionaria de la Tierra, las posturas que potencias mundiales tomaron al respecto y la evolución de las mismas con el tiempo, no sólo de las potencias mundiales sino también de los países ecuatoriales, culminando con la postura que maneja el Ecuador a día de hoy en materia diplomática respecto del acceso equitativo a este recurso natural limitado.
The current investigation work is based on the history about the right of sovereignty that Ecuador have over the synchronic geostationary orbit of the planet, the incidence about the exercise of sovereignty over this space that is considered outer space and a patrimony of the humanity, also this investigation work talks about the necessity of delimitation about the outer space, based on the concepts related to the costumes on the international law, done through an analysis about the benefits and applications that has the synchronic geostationary orbit of the satellites on the day by day living of the human being. Having in mind the incidence of the GEDI project in the current situations of the climatic change, we also analyze the history and incidents on past postures of the equatorial countries diplomacy, related to the use of the synchronic geostationary orbit of the Earth, analyzing the postures of the developed countries about the posture of the equatorial countries, ending with the current official posture of the Ecuadorian State about the equal access to this limited natural resource.
