La presente tesis centra su análisis en la problemática jurídica existente que ocurre cuando existe la duda de si al momento que el juez declara la nulidad del proceso ya sea por omisión o violación de una solemnidad sustancial, aquello incurriría o no en extra petita. A lo largo de la tesis se realiza un recorrido a través de lo que implica ser juez cuando tal omisión no ha sido invocada por ninguna de las partes, del rol de los mismos jueces y como el mismo debe proceder en este caso, respaldando todo con una base sólida de doctrina relacionada al caso concreto. Se ven inmersos temas como el alcance de la nulidad, el principio de congruencia y su relación con la extra petita y de esa forma se ve analizado más de cerca el por qué el juez es o no, un garante de las solemnidades sustanciales, y de lo que ocurre dentrodel proceso civil.
This thesis focuses its analysis on the existing legal problems that occur when there is a doubt as to whether at the time the judge declares the process null and void, either by omission or violation of a substantial solemnity, which would or would not incur extra petita. Throughout the thesis, a journey is made through what it means to be a judge when such omission has not been invoked by any of the parties, the role of the judges themselves and how they should proceed in this case, supporting everything with a solid foundation of doctrine related to the specific case. Issues such as the scope of nullity, the principle of consistency and its relationship with the extra petita are immersed and in this way, it is analyzed more closely why the judge is or is not, a guarantor of substantial solemnities, andof what happens in the civil process?
