Las medidas cautelares constitucionales autónomas y su relación con la tutela autosatisfactiva.

Description: Esta trabajo investigativo tiene como tema de fondo la institución jurídica de las medidas cautelares constitucionales autónomas dentro del ordenamiento jurídico ecuatoriano, en relación a las medidas autosatisfactivas, sus diferentes matices y su aplicación. Para ello se asienta en la tutela judicial efectiva como un derecho del cual nacen otras tutelas y cuyo objeto es garantizar desde distintos enfoques los derechos de los ciudadanos. Es así que a lo largo de la historia, el derecho procesal ecuatoriano ha incorporado una tutela de carácter resarcitorio, evolucionando hasta llegar a una tutela de carácter preventivo. En esta investigación se hará un análisis de su implementación y se determinará si ha sido adecuado o no.
This investigative work has as its underlying theme the legal institution of precautionary measures implemented in constitutional justice within the Ecuadorian legal system, in relation to self-satisfactory measures, their different nuances and their application. For this, it is based on effective judicial protection as a right from which other protections are born and whose purpose is to guarantee the rights of citizens from different approaches. So, throughout history, Ecuadorian procedural law has incorporated a compensatory guardianship, evolving to a preventive guardianship. In this investigation, an analysis of its implementation will be made and it will be determined if it has been adequate or not.
