El tema a investigar repercuta a la dura realidad que siempre ha enfrentado no solamente el Ecuador, sino a nivel internacional, habiendo movimientos en contra de la violencia a la mujer en general. El análisis dogmático se centra en el delito del femicidio, esto es la aplicación de la ley a la realidad, pues muchas veces es confundido con el asesinado o también con el homicidio, tomando decisiones, por parte de los jueces, totalmente erróneas. En efecto, el primer capítulo constaría los antecedentes, la definición del femicidio, el tipo penal en sí y sus características, la diferencia con otros tipos penales; llegando así a un criterio personal del primer capítulo. En el segundo capítulo, correspondería al análisis del problema jurídico del tema; para ello, es necesario analizar la doctrina acerca del femicidio y reforzar con jurisprudencia y casos a la resolución de este tema, ya que ha habido casos que se ha resuelto como un homicidio, dando al infractor de la pena, una cuantía menor. Finalizando con la conclusión y recomendaciones del tema.
The subject to be investigated has an impact on the harsh reality that has always faced not only Ecuador, but internationally, with movementsagainst violence against women in general. The dogmatic analysis focuseson the crime of femicide, this is the application of the law to reality, because itis often confused with the murdered or also with homicide, making decisions, by the judges, totally wrong. Indeed, the first chapter would include thebackground, the definition of femicide, the criminal type itself and its characteristics, the difference with other criminal types; thus arriving at a personal criterion of the first chapter. In the second chapter, it would correspond to the analysis of the legal problem of the subject; For this, it is necessary to analyze the doctrine about femicide and reinforce with jurisprudence and cases the resolution of this issue, since there have been cases that have been resolved as a homicide, giving the offender of the penalty, a lower amount. Ending with the conclusion and recommendationsof the topic.
