El tema del siguiente trabajo de titulación, el mismo que está divido en dos capítulos con sus respectivas conclusiones, deviene de las figuras jurídicas del divorcio y la liquidación de la sociedad conyugal en sede notarial. Abordaremos sus antecedentes como facultades otorgadas a los notarios por medio de reformas a la Ley Notarial. Se analizarán los criterios doctrinales y los conceptos que explican y describen ambas instituciones jurídicas, sus elementos y tipos según las posean y sean vigentes en el país. La problemática que existe en cuanto a la nueva reforma notarial que indica que tanto el divorcio como la liquidación conyugal se pueden realizar en un solo acto, no quedando claro lo que en un solo acto se refiere. También profundizaremos respecto de cuál será entonces el instrumento que se deberá utilizar para inscribir ambos trámites, ya que hasta antes de la reforma notarial cada uno se realizaba en instrumentos jurídicos distintos.
The subject of the following titling work, which is divided into two chapters with their respective conclusions, comes from the legal figures of divorce and the winding up in notarial headquarters. We will approach your background as powers granted to notaries by means of reforms to the Notarial Law. The doctrinal criteria and the concepts that explain and describe both legal institutions, their elements and types as they exist and are valid in the country will be analyzed. The problem that exists in relation to the new notarial reform, which indicates that both, the divorce and the conjugal settlement can be carried out in a single act, not being clear what in a single act is concerned. We will also deepen on what will then be the instrument that should be used to register both procedures, since until before the notarial reform each one was carried out in different legal instruments.
