El manglar es fuente de vida con innumerables beneficios y sujeto de derechos, amparado en la Constitución de la República del Ecuador, art. 10 “La naturaleza será sujeto de aquellos derechos que le reconozca la Constitución”. En efecto, un ecosistema que necesita protección especial, por lo que es importante la generación de conciencia en los territorios para evitar la contaminación con desechos plásticos y otros productos de los estuarios del Manglar. El manglar vive una problemática de contaminación y tala indiscriminada, con afectación también en las comunidades de pueblos y nacionalidades asentadas en dicho territorio, verbigracia, la reserva Mataje-Cayapas, ubicada en la provincia de Esmeraldas. Es evidente, la vulneración de los derechos del manglar, razón que sustenta el objetivo del presente estudio de investigación, expresado en el análisis del manglar como sujeto de derechos, mediante la metodología cualitativa y cuantitativa, enfocado en comprender y profundizar la protección del manglar, desde la perspectiva de los participantes en un ambiente natural, en relación con el contexto, la normativa, jurisprudencia y doctrina. Objetivo ligado al art.1 Código Orgánico Ambiental “Este Código tiene por objeto garantizar el derecho de las personas a vivir en un ambiente sano y ecológicamente equilibrado, así como proteger los derechos de la naturaleza”. Lo que representa los fundamentos jurídicos para salvaguardar los derechos de la naturaleza, del buen vivir, la vida, subsistencia y un medio ambiente sano, así como garantizar mejores condiciones de vida y las bondades naturales del manglar.
The mangrove is a source of life with innumerable benefits and subject to rights, protected by the Constitution of the Republic of Ecuador, art. 10 “Nature will be subject to those rights recognized by the Constitution”. Indeed, an ecosystem that needs special protection, so it is important to raise awareness in the territories to avoid contamination with plastic waste and other products from the Mangrove estuaries. The mangrove is experiencing a problem of contamination and indiscriminate felling, also affecting the communities of peoples and nationalities settled in said territory, for example, the Mataje-Cayapas reserve, located in the province of Esmeraldas. It is evident, the violation of the rights of the mangrove, reason that supports the objective of this research study, expressed in the analysis of the mangrove as a subject of rights, through the qualitative and quantitative methodology, focused on understanding and deepening the protection of the mangrove, from the perspective of the participants in a natural environment, in relation to the context, regulations, jurisprudence and doctrine. Objective linked to art.1 Organic Environmental Code "The purpose of this Code is to guarantee the right of people to live in a healthy and ecologically balanced environment, as well as to protect the rights of nature." What represents the legal foundations to safeguard the rights of nature, good living, life, subsistence and a healthy environment, as well as guarantee better living conditions and the natural benefits of the mangrove swamp.
