La necesidad de la prisión preventiva en un esquema garantista.

La prisión preventiva, dentro del sistema penal es la más efectiva de las herramientas que tienen los jueces a la hora de asegurar la comparecencia del procesado a juicio, así mismo es catalogada como la herramienta que el juez aplicaría en último momento. Sin embargo, es de la misma manera, la más grave, por cuanto se pone en juego la privación de la libertad al procesado antes de ser juzgado. Para omitir toda duda al momento de aplicación de dicha medida, será necesario realizar un examen exhaustivo de acuerdo al caso en particular para aplicar dicha medida al procesado, así mismo respetando los fines que contempla esta figura jurídica. Ahora bien, en estos casos surge la siguiente pregunta, ¿Entraría en contradicción la figura jurídica de la prisión preventiva con el principio de inocencia? Existen pues, otros intereses de por medio que podrían justificar su existencia, mismos que abarcan incluso la más elemental misión del derecho, que es hacer justicia.
Preventive detention, within the criminal system, is the most effective of the tools that judges have when it comes to ensuring the appearance of the defendant in court, and is also classified as the tool that the judge would apply at last moment. However, it is in the same way, the most serious, because the deprivation of liberty is put at stake before the accused. To omit any doubt at the time of application of said measure, it will be necessary to carry out an exhaustive examination according to the particular case to apply said measure to the prosecuted, also respecting the purposes contemplated by this legal figure. Now, in these cases the following question arises, would the legal figure of pretrial detention be contradicted by the principle of innocence? There are, therefore, other interests that could justify their existence, which encompass even the most elementary mission of law, which is to do justice.
