El Trabajo tiene como finalidad analizar la relevancia de la Garantía Constitucional de la Motivación en cuanto a sus Parámetros de Interpretación, a través de una clarificación jurisprudencial que permita reconocer cuáles son las pautas para examinar un cargo de vulneración de la garantía de la motivación, así como también una clarificación terminológica de definiciones importantes como: garantía de la motivación, Test de proporcionalidad, test de ponderación, test de comprensibilidad, relevancia de la motivación, acción extraordinaria de protección, entre otras definiciones, por ser criterios que deberán aplicar los legisladores de nuestro país para una adecuada garantía de la motivación en sus sentencias. Es importante que magistrados y profesionales del derecho lleguen a comprender el rol jurídico de la garantía de la motivación; que no sea solo por fundamentar, la razón del porque se aplica la normativa jurídica, sino más bien sea por el poder tutelar los derechos de las partes intervinientes que inclusive se dé lugar a la existencia de mejores presupuestos al momento de ejercer el derecho de impugnación. La metodología que se aplicó fue cualitativa. Realice un análisis a la sentencia No. 1158-17-EP, de fecha 20 de octubre de 2021, sobre la garantía de la motivación, para evidenciar y dar a conocer la posición dogmática del Tribunal a que si en la sentencia de casación se vulneró el derecho al debido proceso en la garantía.
The purpose of the work is to analyze the relevance of the Constitutional Guarantee of Motivation in terms of its Interpretation Parameters, through a jurisprudential clarification that allows recognizing what are the guidelines to examine a charge of violation of the guarantee of motivation, as well as as well as a terminological clarification of important definitions such as: guarantee of motivation, proportionality test, weighting test, comprehensibility test, relevance of motivation, extraordinary protection action, among other definitions, as they are criteria that legislators must apply. our country for an adequate guarantee of the motivation in their sentences. It is important that magistrates and legal professionals come to understand the legal role of the guarantee of motivation; that it is not only to justify, the reason why the legal regulations are applied, but rather because of the power to protect the rights of the parties involved that even gives rise to the existence of better budgets at the time of exercising the right of challenge. The methodology applied was qualitative. Carry out an analysis of sentence No. 1158-17-EP, dated October 20, 2021, on the guarantee of motivation, to demonstrate and publicize the dogmatic position of the Court that if the appeal sentence violated the right to due process in the guarantee.
