El control del error judicial inexcusable frente a la independencia judicial.

Los funcionarios judiciales necesitan gozar de independencia tanto interna como externa para garantizar su desempeño sin que exista ningún tipo de presión o interferencia, bien sea de otros jueces y funcionarios de la misma función judicial o de otros organismos del Estado. La aplicación de un control disciplinario tiene como finalidad determinar claramente las pautas necesarias para que los funcionarios públicos desempeñen sus actividades en un marco de responsabilidad, es por esto que se hace sumamente importante el régimen disciplinario y debemos entenderlo como un mecanismo que busca el perfeccionamiento de la justicia, respetando siempre el debido proceso para aquellos funcionarios que esténsiendo investigados. En cuanto al control que se ejerce frente al error judicial inexcusable, que es una de las faltas gravísimas contenidas en el Código Orgánico de la Función Judicial y que conlleva la destitución como sanción, podemos encontrar varios problemas, el primero de ellos que es en nuestra legislación no hay una definición clara de lo que es el error judicial y mucho menos, inexcusable; por lo tanto al momento de juzgar si existe o no un error judicial inexcusable no hay determinación en los elementos que lo constituyen.
Judicial officials need to have both internal and external independence to ensure their performance without any outside pressure or interference, either from other judges and/or officials from the same judicial branch or from other State agencies. The implementation of disciplinary controls have the purpose of determining the necessary guidelines, for public officials, to carry out their activities within a framework of responsibility, which is why a disciplinary regime becomes essential and we must be seen as a mechanism that seeks the improvement of the justice system following due process requirements for those officials who are being investigated. Regarding the control exercised against an inexcusable judicial error, which is one of the most serious misconducts sanctioned with dismissal by the Organic Code of Judicial Function, we find several issues, the first of them being that within our legal framework there is no clear definition of what constitutes a judicial error, much less what an inexcusable judicial error is; therefore when judging whether or not an inexcusable judicial error exist we find that there is not a legal definition or the elements that constitute an inexcusable judicial error.
