Description

El Derecho Notarial es una rama del Derecho Público que va a regular y estudiar la institución del notariado y el instrumento público, conocido como escritura pública. Los notarios son los profesionales del Derecho que se dedican a garantizar la legitimidad de los documentos en los que interviene y proporciona seguridad jurídica y certeza a los actos y hechos de los que da fe. Los servicios notariales son públicos y el notario en el Ecuador depende de un control administrativo por parte del Consejo de la Judicatura, por lo cual, el notario es considerado funcionario público pero para efectos de contratar personal son funcionarios privados. La Ley Notarial fue promulgada en el Gobierno de Clemente Yerovi Indaburu y ésta se encuentra en vigencia. Sin embargo, tenemos leyes especiales que forman parte del Derecho Notarial, por ejemplo tenemos los siguientes: -Código de la Niñez y Adolescencia; - Ley Orgánica de Contratación Pública; - Código Orgánico de Organización Territorial, Autonomía y Descentralización; - Reglamento de la ley de venta de bienes por Sorteo; - Ley de Compañías; -Código de Comercio; - LOEPS; - Reglamento de casilleros judiciales en bancos.
Notarial Law is a branch of Public Law that will regulate and study the institution of the notary and the public instrument, known as public deed. Notaries are legal professionals who are dedicated to guarantee the legitimacy of the documents in which they intervene and provide legal security and certainty to the acts and facts of which they attest. Notarial services are public and the Notary in Ecuador depends on an administrative control called “Consejo de la Judicatura”, therefore, the notary is considered a public official but for purposes of hiring personnel are private officials. The Notary Law was enacted during the government of Clemente Yerovi Indaburu and is still in force. However, we have special laws that are part of the Notarial Law, for example we have the following: - Childhood and Adolescence Code; - Organic Law of Public Contracting; - Organic Code of Territorial Organization, Autonomy and Decentralization; - Law regulations on sales of goods by legal draw; - Law of Companies; - Code of Commerce; - “LOEPS”; - Regulation of judicial lockers in banks.
