The aim of this study is to establish if people of other nationality have the right to social protest within the Ecuadorian legal framework by analyzing the international rules related to human rights in the area of freedom of expression. The first chapter will focus on the theoretical construction of the right to a social protest in accordance with the concepts of human rights and the practice of freedom of expression. Second chapter explain Manuela Picq case detailing the facts, and how the events occurred and the way this situation was set in the international standards of human rights along with the analyzing of freedom of expression that Ecuadorian legislation concerns about. Having in mind the standards develop in charter one we analyze the case to determine if the Ecuadorian State violated or not the right to a social protest in relation to Manuela Picq rights and if people with other nationality have the right to protest.
El presente trabajo tiene por objeto establecer si las personas de otro origen nacional tienen derecho a la protesta social dentro del marco jurídico ecuatoriano, analizando conjuntamente la normativa internacional relacionada a los derechos humanos en materia de libertad de expresión. El primer capítulo se centra en la construcción teórica del derecho a la protesta social, en lineamiento con los conceptos de derechos humanos y como manifestación del ejercicio a la libertad de expresión. En el segundo capítulo se hablará sobre el caso “Manuela Picq” detallando los hechos del caso, donde se relatarán cómo sucedieron los acontecimientos; y, por último, el análisis del caso a luz de los estándares internacionales de derechos humanos, conjuntamente con el análisis la normativa ecuatoriana referente a libertad de expresión. Finalmente se integraran todos los elementos analizados para determinar si existió una violación por parte del Estado ecuatoriano respecto de los derechos de Manuela Picq.
