La ineficacia de la acción de repetición en contra de los servidores públicos en la legislación ecuatoriana

Description: The objective of this paper is to analyze the ineffectiveness of the action of repetition in Ecuador, starting from the subjective responsibility of the State, defining who the public servants are, up to presenting the demand for repetition against the officials or former officials who due to their actions they have caused a patrimonial damage to the State, we will also analyze different legislations to see what they establish about the action of repetition, and we will present some recommendations so that in the future the action of repetition will be effective.
El presente trabajo tiene como objetivo analizar la ineficacia de la acción de repetición en el Ecuador, partiendo desde la responsabilidad subjetiva del Estado, definiendo quienes son los servidores públicos, hasta llegar a presentar la demanda de repetición en contra de los funcionarios o ex funcionarios que por su accionar han causado un perjuicio patrimonial al Estado, además analizaremos diferentes legislaciones para ver lo que éstas establecen acerca de la acción de repetición, y presentaremos algunas recomendaciones para que en un futuro la acción de repetición sea eficaz.
