Description

The main object of this work is to realice a analization about the regimen of furthes responsability in the proyect of the comunication law and in the ecuatorian legislation, to messure the grade of compatibility existing in this legislation and the human rights. Also its important to go to the comparation of rights to analize the legislation which have ocupied countries in latinamerica and same others who aclieved same progress in the issue of comunication and who havr shown an example of change for the liberty of expression. Its also importatnt tos ay that basic concepts of comunication and information have been investigated to introduce previously the issue of liberty of expression. Therefore the aplication of the regimen of furthes responsability inside the criminal field in Ecuador and in the legislations of countrys like Argentina, Panamá, Costa Rica and others was analized. For the right if rectification the efficiency of the furthes responsability has been analized studying the legislation of rasious countries. To realice all this investigation, we mainly treakd the cases and laws of the interamericas sort of humnas rights based is the universal declarations of human rights and the American Convention of Human Rights as the “San Jose de Costa Rica” agreement. The results are the comparisin between various lagislations of diferent countrys. Ecuador has to have a law which aplies the regimen of responsabilitys like it is disposed in the article 13 if the American Convention of human rights, with the special exceptions in this norm, so they won’t convert in cersorship which the human rigths don’t allow. This is the reason for the present investigation
El objetico principal de este trabajo, es realizar un análisis sobre el régimen de la responsabilidad ulterior en el proyecto de ley de comunicación y en la legislación ecuatoriana, para medir el grado de compatibilidad que existe entre esta legislación y los derechos humanos, además es importante acudir al derecho comparado para analizar la legislación que han ocupado países de Latinoamérica y algunos otros que han logrado estar un paso adelante en el tema de comunicación sentando precedentes como ejemplo de cambio para una libertad de expresión propiamente dicha...
