The post mortem or posthumous assisted reproduction generates a series of consequences not only biological and medical ones, also legal consequences, this is because the assited reproduction in general terms contains legal acts and legal facts like the contract, testament, born, dead, sucession as the acquisition of right and some fundamental rights that allow the integral development of a human. This set of legal acts and legal facts will permit the access to the heritage of the father to the posthumous son daughter, considerate the product of the posthumous assisted reproduction; this is possible through a judicial proceeding where firstly the link is going to be demostrated with the ius sanguini that is going to be stablish through the DNA test, and then the son will attend to the process of succession.
La reproducción asistida post mortem o posterior a la muerte genera una serie de consecuencias no únicamente biológicas y médicas sino también jurídicas; ya que, la reproducción asistida en un término general contiene actos y hechos jurídicos, entre ellos el contrato, el testamento, el nacimiento, la muerte, la filiación, la sucesión por causa de muerte como un modo de adquirir el dominio, y varios derechos fundamentales del ser humano que permite un desarrollo integral. Este conjunto de estos actos y hechos van a permitir acceder al patrimonio del padre hacia el hijo póstumo, producto de la reproducción asistida posterior a la muerte; esto mediante un procedimiento judicial donde inicialmente se va a reconocer y establecer el vínculo de sangre o ius sanguini a través de medios como el examen de ADN para posteriormente acudir al llamamiento de la sucesión por causa de muerte.
