The project of academicals degree that developed in the following lines detected the roll that develops the Nature within the cultural, sociological, scientific, political and legal scope; For this purpose was taken into account the gross treatment that Nature has suffered from the hand of man; In addition, it have been analyzed the legal mechanisms that have been formulated so far, to activate the guarantees for the rights of the generatrix of life: Nature; This essay was oriented to promulgate the use, enjoyment and efficient exercise of the rights of Nature; The form of administering justice that the judges have described to their true knowledge and understanding as the most suitable to give it special protection, even more with the new ecological political tendencies, adopted by the present government, was also carefully studied. In the first instance, a strictly theoretical and doctrinal approach was adopted. For this purpose, the most basic definitions were formulated, which served as a fundamental pillar in the development of this work when it came to finding the true spirit of what was stated here and was proposed. Consequently, it was necessary to study the Cosmo-vision of Nature, in the various fields of action in which it is immersed together with the human being, whose starting point was to locate the study in the historical point where religion played an important role, happening through the time, finding science as a determinant element to understand Nature until arriving at the present. Finally, specific cases were taken with the purpose of synthesizing the parameters that the various judges have taken into consideration when deciding in their natural rights judicatures, and parameters were proposed so that their sentences in the future are pronature.
El proyecto de titulación que se desarrolló en las siguientes líneas detectó el rol que desarrolla la Naturaleza dentro del ámbito cultural, sociológico, científico, político y jurídico; para este propósito se tomó en consideración el grosero trato que la Naturaleza ha sufrido de la mano del hombre; además se analizaron los mecanismos legales que se han formulado hasta el momento, para activar las garantías a los derechos de la generatriz de vida: Naturaleza; este ensayo estuvo orientado a promulgar el uso, goce y eficiente ejercicio de los derechos de la Naturaleza; también se estudió cautelosamente la forma de administrar justicia que los jueces han calificado a su leal saber y entender como lo más idóneo para dotarle de una protección especial, más aún con las nuevas tendencias político ecológicas, que adopta el Gobierno de turno. En primera instancia se adoptó una postura estrictamente teórica, doctrinaria, para cuyo efecto se plantearon las definiciones más básicas, que sirvieron en todo el desarrollo de esta obra como pilar fundamental al momento de encontrar el verdadero espíritu de lo que aquí se afirmó, se sostuvo y se propuso. Consecutivamente, fue necesario estudiar la cosmovisión con que se le concibe a la Naturaleza, en los diversos campos de acción en que se ve inmersa conjuntamente con el ser humano, cuyo punto de partida fue ubicar esta investigación en el punto histórico donde la religión jugó un papel importante, pasando a través del tiempo encontrándose a la ciencia como elemento determinante para comprender a la Naturaleza hasta llegar a lo presente. Finalmente se tomaron casos puntuales con el propósito de sintetizar los parámetros que los variopintos jueces han tomado en consideración al momento de resolver en sus judicaturas derechos de la Naturaleza, y se plantearon parámetros para que sus sentencias en lo venidero sean pro-Naturaleza.
