The subject of Pardon to the people who are in final stage of a certain disease is the objective of the present project, that will as well fulfill a human right that is the freedom and the quality of Life of the person as well as the purge of the penitentiary system and finally the work of the State and the society towards these people. But it is possible to become the following question: Is feasible the creation of an effective procedure of pardon in Ecuador, towards the sentenced people who suffer of a terminal disease? It is possible this, insomuch as the Law of Grace exists, as well as the procedures established in the Constitution for the granting of humanitarian measures, nevertheless during the use of the Constituent Assembly has demonstrated signals to be able to carry out this possibility by means of the resolution in which it grants freedom to terminal patients. By means of testimonies, referring statistics and aspects to the historical penal reality in the country have been the pillars for the elaboration of the present work.
El tema del indulto a las personas que se encuentran en fase terminal de una enfermedad determinada es el objetivo del presente proyecto, que a su vez cumplirá con un derecho humano que es la libertad y la calidad de vida de la persona, así como la depuración del sistema penitenciario y finalmente la labor del Estado y de la sociedad hacia estas personas. Pero cabe hacerse la siguiente pregunta. ¿Es factible la creación de un procedimiento eficaz de Indulto en el Ecuador, hacia las personas sentenciadas que padecen de una enfermedad terminal? Es posible esto, por cuanto existe la ley de Gracia, así como procedimientos establecidos en la constitución para el otorgamiento de medidas humanitarias, sin embrago durante la vigencia de la Asamblea Constituyente ha demostrado señales de poder llevar a cabo esta posibilidad mediante la resolución en la que otorga libertad a enfermos terminales. Mediante testimonios, estadísticas y aspectos referentes a la realidad penal histórica en país han sido los pilares para la elaboración del presente trabajo.
