Inheritance can be highly problematic in certain cases. Since the main object of this legal act is the transfer of assets, there is a conflict especially when there is no agreement between heirs and / or legal ties - a situation in which the legal system plays a fundamental role. The rules and guidelines must be determined so that this process can be carried out without affecting the rights of the participants. This process simply begins with the determination of the controversial assets. This is done through the taking of inventory, which results in a partition made between the heirs and / or legal ties, done by a judge who takes all circumstances into consideration. In our legislation, there are still some loopholes that must be regulated, especially at this time when there have been significant legislative changes especially in procedural matters.
La sucesión constituye un asunto sumamente problemático en ciertos casos, ya que el objeto principal de este acto jurídico es la transmisión de bienes, existe conflicto específicamente cuando no existe un acuerdo entre los herederos o legatarios, situación en la cual el ordenamiento jurídico juega un papel fundamental. Se debe determinar las normas y pautas para que este proceso se lleve a cabo sin afectar los derechos de los intervinientes. Este proceso de manera muy superficial inicia con la determinación de los bienes que se encuentran en controversia, esto a través de un inventario, lo que genera que se realice la partición de los mismo entre los herederos y/o legatarios, misma que es realizada por el juzgador considerando varios aspectos. En nuestra legislación aún existen algunos vacíos legales que deben ser normados, sobretodo en este momento que se han producido grandes cambios legislativos especialmente en materia procesal.
