Cultura libre y propiedad intelectual desde una perspectiva Latinoamericana

Description

This is a journey through the historical manifestations that representad free culture in the 18th and 19th Centurias, between 1800 and 1900, through Romanticism and its permanent search for true and inalienable freedom, valued as the motor of life and being a motivation to overcome any atrocity in order to attain it. This brings us close to 1916 where we can see ourselves reflectad on the mirror of Dadaism with its poetic soirées, believing in diversa sensory experiences without any mercantile or contemplativa attachment and therefore setting a very critica! point of reference in relation to what had been considerad to be art, strongly questioning old traditional and schematic concepts and betting on the destruction of codes and systems as established, advocating for individual freedoms and the defensa of chaos against order. The rebellious and non-conformist feelings towards the system were the minimum expressions of whatever Punk in the 70's wished to demonstrate in its profound aspiration to the truth and to never give up free thought, all of this being materializad in the "Do it Yourself' motto and linked to Cyberpunk by fanzines, hackers and science fiction, announcing a possible future with clear intentions in connection with the appropriation of knowledge and information. And so it must be, considering that knowledge and information are the new parameters on which power is held, which make them very attractive to multinational companies, questioning the role of the nation-state. A mixture of communication channels and media through which libertarian contents are vented, from gender issues and cooperativa work to networks evidencing a horizon of strengthened possibilities with similar and always collaborative conceptions, intends to bring about a process of collective construction of knowledge and to transform competition into collaboration, thus allowing free, harmonic and balanced exchanges in order to create a system that shows respect towards a diversity of cultures and life forms. Our realities as Southern countries are linked to solidary environments and objectives. We wish to liberate ourselves from an individual property criterion in arder to allow a collective and communitarian property concept without any place for envy and selfishness. lntellectual goods had always been free, and now it is necessary to recover them without criticizing the system per se but, instead, by adapting technical and juridical mechanisms to maintain freedom of access, modifications and re-distributions relating to software with GPL licenses or to other type of works through Creativa Commons licenses, under the Copyleft principie.
Un paseo por manifestaciones históricas que daban cuenta de la cultura libre desde el siglo XVIII y siglo XIX entre los años de 1800 a 1900 con el romanticismo y su búsqueda constante de la libertada autentica e irrenunciable, valorada como su motor de vida, superando cualquier atrocidad por conseguirla. Esto nos acerca a 1916 y nos refleja en el espejo del dadaísmo con sus poéticas veladas, apostando por experiencias sensoriales diversas sin apegos mercantilistas y contemplativos, marca un punto de referencia muy crítico con lo que se consideraba arte, cuestionando fuertemente anterioridades esquemáticas y tradicionales, apostando por la destrucción de códigos y sistemas establecidos, propugnando la libertad del individuo y defensa del caos, frete al orden. Sentimientos rebeldes y contestatarios del sistema son mínimas expresiones para definir lo que el punk en los 70's quería manifestar en su profunda aspiración de encuentra la verdad y no claudicar a su pensamiento libre, materializadas en el Do it Yoursef y conectadas con el cyber punk entre fanzines, hackers y ciencia ficción, anunciando un fututo posible de claras intenciones a la apropiación del conocimiento y la información y como no, si estos son los nuevos parámetros sobre los que se detenta el poder, haciéndolo muy atractivo a las multinacionales dejando en entre dicho el papel del Estado Nación. Amalgama de canales comunicacionales y medios a través de los cuales se encuentran desfogues de cargas libertarias, desde cuestiones de género, mingas, redes que dejan en evidencia su horizonte de posibilidades fortalecidas con concepciones afines siempre colaborativas, procurando plantear procesos de construcción colectiva del conocimiento. Cambiando la visión de competencia por la de colaboración, permitiendo libres flujos de intercambios armónicos y equilibrados en miras de un sistema que respeta la diversificación de culturas y seres vivos. Nuestras realidades como países del sur responden a otros entornos y fines solidarios. Desprendemos del criterio de propiedad individual para dar paso a una propiedad colectiva y patrimonial, la envidia, el egoísmo no tienen cabida, los bienes intelectuales siempre fueron libres ahora se los pretende recuperar sin criticar per se el sistema, sino valiéndonos de él, adaptar mecanismos técnicojurídicos para mantener la libertad de acceso, modificaciones y redistribuciones en cuanto a software con licencias GPL o en a otro tipo de obras por medio de licencias Creative Commons, amparadas en el principio copyleft
