Se pretende determinar el alcance del artículo 402 de la Constitución del Ecuador 2008, referente a los derechos colectivos de propiedad intelectual. Dicho texto legal dispone que se prohíbe el otorgamiento de cualquier tipo de derechos sobre conocimientos colectivos, aseveración que es contraria a cerca de toda legislación, tanto nacional como internacional, vigente. Se analiza en detalle los diferentes cuerpos legales relacionados al tema, con lo que se concluye, tras una ponderación, sobre la eficacia del artículo constitucional. Las incongruencias que se expresan en el artículo 402 de la Constitución se evidencian clara y notoriamente, lo que supone un debate relevante al tema.
