Inconstitucionalidad del Solve et repete

Description: The solve et repete rule is an anachronistic juridical figure that has been used by many countries to ensure, at any cost, the collection of the taxes; the Reformatory Law for the Tributary Equity instituted this rule in Ecuador, rule that lessens constitutionals rights and principals, that are also consecrated on international instruments such as the American Convention of Human Rights.
La regla solve et repete es una figura jurídica anacrónica que ha sido utilizada por los Estados para asegurar, a cualquier costo, el cobro de los tributos; la Ley Reformatoria para la Equidad Tributaria instituyo esta regla en el Ecuador, regla que menoscaba derechos y principios jurídicos, no solo consagrados en la Constitución sino también en instrumentos internacionales como la Convención Americana de Derechos Humanos.
