El presente proyecto de investigación es importante por tratarse de la eficacia de medidas de solución rápida para resolver controversias entre la sociedad, no siendo así que la resolución de litigios en donde la sentencia de un juez se ha constituido en el medio tradicional de terminación de un proceso, sin optar por otras vías; es decir, no derivan las causas a métodos alternativos para la solución de conflictos como son: la mediación, el arbitraje. Es por estos casos que han motivado el estudio de esta problemática que se está dando en las unidades judiciales del cantón Ambato, que a pesar que el juez derive la causa los petitorios rechazan la misma y optan seguir el proceso por vía de jurisdicción ordinaria, causando así el congestionamiento de la administración de justicia. A nivel mundial la mediación se ha convertido en un mecanismo para solucionar conflictos de manera pacífica y en razón de ello estos mecanismos han ido tomando fuerza a través de los años
