El trabajo, al ser la base de la economía y el pilar fundamental de todas las familias, debe ser respetado, valorado y accesible para todos sin distinción. La presente investigación ¿Despido Ineficaz o Discriminación a la Mujer Embarazada? "Análisis de Sentencias emitidas en Cuenca durante el año 2016" analiza el verdadero alcance de la protección que busca la figura del Despido Ineficaz a mujeres embarazadas o en condición de maternidad, a nivel privado en el ámbito laboral; la aplicabilidad de esta norma, los derechos que la misma ampara; y la situación en la que se encuentran las mujeres que viven esta realidad. Como avanza la investigación se encuentra que la aplicación de la norma no está surtiendo los efectos que se esperaba cuando fue creada, es decir con ella se buscaba la estabilidad laboral una mayor protección a la mujer trabajadora, contra las decisiones y en algunos casos las injusticias por parte de los empleadores pero en realidad se está convirtiendo en una limitación a los derechos de las trabajadoras y en parte condicionando su acceso a las fuentes de trabajo. El trabajo de campo se realiza por medio de entrevistas a personas con amplia experiencia en el medio laboral, que tienen una visión extensa sobre este tema. Finalmente se recomienda reformas tanto al Código del Trabajo y a la Ley de Justicia Laboral y Reconocimiento del Trabajo en el Hogar, en busca de una efectiva protección para la mujer trabajadora, a más de la igualdad de derechos y oportunidades en el mercado Laboral.
Labor, being the basis of the conomy and the fundamental pillar of all families, must be respected, valued and accessible to all without distinction. The present investigation Ineffective Dismissal or Discrimitation against Pregnant Women? "Analysis of Sentences issued in Cuenca during 2016" analyzes the true scope of the protection sought by the Ineffective Dismissal of pregnant women or women in maternity status, at the private level in the workplace; the applicability of this norm, the rights that it protects; and the situation in which women who live this reality are. As the investigation progresses, it is found that the application of the norm is not having the effects that were expected when it was created, that is to say, it sought employment stabiliy and greater protection for working women, against decisions and in some cases injustices on the parte of the employers but in reality it is becoming a limitation to the rights of the workers and partly conditioning their access to the sources of work. The fiel work is done through interviews with people with extensive experience in the workplace, who have an extensive view on this subject. Finally, it is recommended to reform both the Labor Code and tha Labor Justice and Home Work Recongnition Law, in search of effective protection for working women, in addition to equal rights and opportunities in the labor market.
